In return for allowing you access to this website, we require you to accept the terms and conditions of use set out in this notice. If you are not prepared to agree to these terms then you must immediately leave this website and you may not use or access our services or our site’s facilities.
These terms of use are a legal agreement between us and describe the terms and conditions applicable to your use of our website and the services we offer including the sale of goods to consumers. These terms may be modified by us from time to time and are available here.

You agree that the owners of this website exclusively reserve the right and may, at any time and without notice and any liability to you, modify or discontinue this website and its services or delete the data you provide, whether temporarily or permanently. We shall have no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy or improper delivery of any data or information.

3. Your Responsibilities and Registration Obligations

In order to use this service, you must register and agree to provide truthful information when requested. When registering, you explicitly agree to our Terms and Conditions.

Registration data and other personally identifiable information that we may collect is subject to the terms of our Privacy Policy.

5. Registration and Password

You may browse our website without registering but will need to register to become an online customer with us in order to purchase any goods via our website.
When you become an online customer your username will be your valid email address and you will be asked to input a password.
You are responsible for all actions taken under that username, whether by you or any other person. It is your responsibility to keep your username and password safe. You should not disclose or transfer your username or password to any other person and you must notify us immediately if you become aware of any unauthorized use of your username or password.
You warrant, represent and undertake that any information, which you provide when you register as a user, shall be up to date, true and accurate in all respects, and you agree to notify us immediately of any changes to such information.
You are responsible to maintain the confidentiality of your password and shall be responsible for all uses via your registration and/or login, whether authorized or unauthorized by you. You agree to immediately notify us of any unauthorized use or your registration, user account or password.

You explicitly agree, in using this website or any service provided, that you shall not:
(a) Provide any content or perform any conduct that may be unlawful, illegal, threatening, harmful, abusive, harassing, stalking, tortious, defamatory, libelous, vulgar, obscene, offensive, objectionable, pornographic, designed to or does interfere or interrupt this website or any service provided, infected with a virus or other destructive or deleterious programming routine, give rise to civil or criminal liability, or which may violate an applicable local, national or international law;
(b) Impersonate or misrepresent your association with any person or entity, or forge or otherwise seek to conceal or misrepresent the origin of any content provided by you;
(c) Collect or harvest any data about other users;
(d) Provide or use this website and any content in a manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising without our prior written consent;
(e) Provide any content that may give rise to our civil or criminal liability or which may constitute or be considered a violation of any local, national or international law, including but not limited to laws relating to copyright, trademark, patent, or trade secrets;
(f) Infringe on any copyrights or intellectual property rights.

7. Descriptions and Product Information

All products displayed on this website are available only whilst stocks last. Every effort has been made to reflect product colours as accurately as possible. However, due to factors such as differences in monitors and screen settings, we are unable to guarantee that the colour you will see on your monitor will accurately reflect the true colour of the product.

8. Pricing

All prices are quoted inclusive of packaging, costs of postage will be charged at the rates specified and required during the checkout process. Cost of postage will de decided by the buyer when choosing a method for delivery.

Where there is a delay or likelihood of delay in the supply of products, we will advise you as soon as practicable. If the products cannot be delivered within 30 days of your order, we will notify you of this delay and you may either cancel your order or agree a further delivery time with us.

Any orders you place with us will not be accepted and no contract will be formed between us until you have been instructed that said goods are available and that these goods have been paid for and all applicable charges paid in full. No payment shall be deemed to have been received until we have received payment in cleared funds.
We will confirm our acceptance of your order prior to dispatch of your goods by email (where a valid email address is provided).

9. Delivery

We will despatch your order within three (3) working days of receiving payment.

We do not take responsibility for late or non-delivery due to factors outside our control.

All deliveries require a signature of the buyer or a person authorized by the buyer to do so, so please ensure somebody is in to sign for the goods. If you are not in to receive goods, you can contact the courier to arrange a new delivery time. You also have the opportunity to add any special delivery instructions during the ordering process. We can take no responsibility for any delivery problems arising from incomplete or incorrect address details supplied by you.

10. Returns

14 -30 days Returns Policy

You know you’re in safe hands with Oxywat, our products have a 30 day money back guarantee. If you change your mind, just return it unused, in its original condition with your receipt to any Oxywat within 30 days, we’ll either give you a full refund

The right to cancel starts the moment you place your order and does not end until fourteen days from the day after you receive your goods.

If you wish to cancel before we have dispatched the goods then please email to cancel @ oxywat.co.uk.

If you wish to cancel after we have despatched the goods then please email to cancel @ oxywat.co.uk to arrange a return.

If the return is for reasons other than faulty/incorrect goods then we will need to ask you to cover the cost of returning the goods to us.

It is your responsibility to take reasonable care of the items you purchased.

We reserve the right to reject an order if we suspect that a customer is taking advantage of our returns policy (such as using significant proportion of the cartridges provided, that is using more than 14 catridges within 14 days).

Please, keep hold of the original packaging as it is needed when returning the goods.

We require all items are sent back by special delivery. We do not take any responsibility for items that are not delivered and request that you contact Royal Mail directly.

You must contact us if you are returning your order by email at cancel @ oxywat.co.uk.

The purchase price will be returned to the buyer’s bank account within 30 days after receiving the returned goods.

Attention!
It is important to know that if you start using the product after its purchase, you can no longer desist from the purchase. The right to desist from the purchase does not mean the free use of the product for 14 days, it means you can change your mind about the purchase if you would like to. The Oxywat cartridges are disposable products so they cannot be sold to others.
The refunding of the purchase price can only take place if the product is in its original, unopened package.
The Oxywat provides a possibility to desist from the purchase even in case of tried and used products, but in this case the prices listed in the Parts menu are deducted from the price. Furthermore, in this case, the return shipping costs shall be paid by the buyer.

11. Indemnification

You agree to indemnify and hold our subsidiaries, affiliates, related parties, officers, directors, employees, agents, independent contractors, advertisers, partners, and co-branders from any claim or demand, including reasonable legal fees, that may be made by any third party, that is due to or arising out of your conduct or connection with this website or service, your violation of these Terms and Conditions or any other violation of the rights of another person or party.

12. Limitation of Liability

You expressly understand and agree that we shall not be liable for any direct, indirect, special, incidental, consequential or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data or other intangible loss (even if we have been advised of the possibility of such damages), resulting from or arising out of; (I) The use of or the inability to use the Service; (II) The cost to obtain substitute goods and/or services resulting from any transaction entered into on or through this Service; (III) Unathorized access to or alteration of your data transmissions; (IV) Statements of conduct of any third party on the Service, or; (V) Any other matter relating to the Service. In some jurisdictions, it is not permitted to limit liability and therefore such limitations may not apply to you.

13. Guarantee

There is a two-year guarantee on our goods. If the return is for faulty/incorrect goods then we are to cover the cost of returning the goods to us. It is the buyer’s responsibility to contact us as soon as the fault is discovered. After receiving the faulty good, we are sending a new one free of charge within 3 working days.

We provide an extended guarantee, as well (2+3 years), which can be enforced in two ways:
– The cost of returning the faulty good and the cost of the delivery of the new one will be covered by the buyer;
– The spare part(s) and the instruction will be sent to the buyer free of charge.

14. Reservation of Rights

We reserve all of our rights, including but not limited to any and all copyrights, trademarks, patents, trade secrets, and any other proprietary right that we may have in our website, its content, and the goods and services that may be provided. The use of our rights and property requires our prior written consent. We are not providing you with any implied or express licenses or rights by making services available to you and you will have no rights to make any commercial uses of our website or service without our prior written consent.

15. Applicable Law

These terms of use, contracts for the purchase of products made via our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with English law and you agree that the English courts will have exclusive jurisdiction for any dispute under this agreement.
16. Miscellaneous Information

(I) In the event that these Terms and Conditions conflicts with any law under which any provision may be held invalid by a court with jurisdiction over the parties, such provision will be interpreted to reflect the original intentions of the parties in accordance with applicable law, and the remainder of these Terms and Conditions will remain valid and intact; (II) The failure of either party to assert any right under these Terms and Conditions shall not be considered a waiver of any that party’s right and that right will remain in full force and effect; (III) You agree that without regard to any statue or contrary law that any claim or cause arising out of this website or its services must be filed within one (1) year after such claim or cause arose or the claim shall be forever barred; (IV) We may assign our rights and obligations under these Terms and Conditions and we shall be relieved of any further obligation.
(II) All brand names, product and service names and titles and copyrights used in this site are trademarks, trade names, service marks or copyrights of their respective holders. No permission is given by StrategicFood Limited for their use by any person other than the said holders and such use may constitute an infringement of the holders’ rights.
(III) All designs, text, graphics and their selection and arrangement on this website are the copyright of Strategicfood Limited or its content providers. Permission is granted to users to electronically copy or print portions of this site for their own personal, non-commercial use. Any other use of materials on this site without Strategicfood Limited prior written consent is strictly prohibited.
